It is the customers right to purchase and supply certain goods for use and
installation
in his/her home by Chuck's Better Home, LLC. In that respect the manufacturer
may warrant the goods sold to the customer. Chuck's Better Home, LLC makes
no warranties, express or implied, including any implied warranties of
merchantability or fitness, with respect to such goods or the installation
of such goods purchased by the customer or any other party for use in the
customers home that is not purchased by or supplied by Chuck's Better
Home, LLC.
In no event shall Chuck's Better Home, LLC be liable to anyone for any delays,
inaccuracies, errors or omissions with respect to information or the transmission
or delivery of all or any part thereof, for any damage arising therefrom
or occasioned thereby, or for the results obtained from the use of the materials
or information. The entire risk as to the quality and performance of materials,
parts, manuals, etc. and the accuracy, adequacy, completeness, currentness,
validity and quality of any product or Information is with the USER.
IN NO EVENT WILL CHUCK'S BETTER HOME, LLC BE LIABLE TO ANY PARTY (i) FOR
ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING,
BUT NOT LIMITED TO, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION,
), OR ANY OTHER DAMAGES ARISING IN ANY WAY OUT OF THE AVAILABILITY, USE,
RELIANCE ON, OR INABILITY TO USE ANY 'INFORMATION' 'PART' 'MANUAL' OR
'WHOLEGOOD', EVEN IF CHUCK'S BETTER HOME SHALL HAVE BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE FORM OF ACTION, WHETHER
IN CONTRACT, TORT, OR OTHERWISE; OR (ii) FOR ANY CLAIM ATTRIBUTABLE TO ERRORS,
OMISSIONS, OR OTHER INACCURACIES IN, OR DESTRUCTIVE PROPERTIES OF ANY MATERIALS,
PARTS, MANUALS, WHOLEGOODS, INFORMATION ETC..
Prices of goods from manufacturers are subject to change.
If an item that is to be supplied by Chuck's Better Home, LLC has risen
significantly in price after the initial quote has been accepted by
the customer, a change order must be signed by the customer to accept the
new price.
We will NOT start or proceed with any job without the expressed
signed approval of the customer if the price of an item is
significantly
different than that initially quoted.
